VMail Terms of Usage

Spirit of VMail

VMail exists for the purpose of providing a secure and verifiable communication channel, free of unwanted and/or potentially dangerous mail content, between enabled sites. As such, any use of VMail other than for sending "legitimate" mail is strictly prohibited and will result in exclusion from the system.

The term "legitimate mail" is purposely vague. Some illegitimate mail is easily identifiable as it may contain viruses, links to sites that install so-called malware, may attempt to entice the receiver to divulge priviledged information (so-called phishing) or other content that is inherently dangerous or deceptive. This type of mail, of course, is prohibited.

Spam, on the other hand, is in the eye of the beholder and therefore more difficult to define. Still, most of what one would call spam is easily identified and classified as such by the overwhelming majority of people. This is normally what is called Unsolicted Bulk E-Mail and is also prohibited.

In short, we cannot and will not attempt to define the meaning of "legitimate mail" other than to say that VMail exists for the purpose of sending and receiving mail that is deemed "legitimate" by the receiver of the mail. Complaints from receivers can therefore lead to exclusion from the system so if you are in doubt, don't send it.

Availability of Service

VMail is available to any company, organization, government agency, individual or entity that satifies Verimation's and/or its designated representative's qualification process. The nature and extent of the process shall be determined solely by Verimation and may change, without notice, from time to time. The exact nature of the qualification process varies from country to country due to many factors, including, but not limited to, applicable local law. In all cases, however, the process is designed to:

  • Ensure applicants accurately identify and represent themselves in accordance with the "Spirit of VMail".
  • Are not now, nor have ever been, engaged in activity in violation of the "Spirit of VMail".

Denial of Service

Verimation reserves the right to exclude any entity from VMail without notice and for any reason at its sole discretion. Reasons for exclusion include, but are not limited to:

  • Any use of VMail that is deemed to be in violation of the "Spirit of VMail".
  • Non-payment for software or services in a timely and contractually agreed upon manner.

Reinstatement of Service

Any entity excluded from the system may apply for reinstatement. The process for reinstatement varies depending upon why the entity was excluded and is therefore handled on a case-by-case basis. The decision to reinstate or not lies solely with Verimation.

Limitation of Liability

Verimation assumes no responsibility for the validity of the content of any mail sent via VMail. Neither does it assert that VMail cannot nor never will be used by anyone in a way that is in violation of the "Spirit of VMail". Therefore, Verimation assumes no liability for direct or indirect costs incurred from the use of, or exclusion from, the VMail system.

Applicable Law

Claims arising through the use of, or exclusion from, VMail shall be governed by the laws of Sweden.
